Agreement to Terms

By accessing or using StudyDek (the "Service") at studydek.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

If you are a parent or guardian agreeing to these Terms on behalf of a minor, you accept these Terms on the minor's behalf and are responsible for their use of the Service.

Description of Service

StudyDek is an educational platform that provides digital flashcards, quizzes, and practice activities for learning and study purposes. The Service includes:

Pre-made educational content for various subjects and grade levels
Tools for users to create their own flashcard decks
A Practice section designed for younger learners (ages 5-11), which can be used without an account

User Accounts

Account Creation

To access certain features (such as saving custom decks), you must create an account. You agree to:

Provide accurate and complete information
Maintain the security of your account credentials
Notify us immediately of any unauthorized access
Accept responsibility for all activity under your account

Guest Access

Many features of the Service, including the Practice section, can be used without creating an account. Guest study progress is stored locally in your browser.

Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion. You may delete your account at any time through your account settings.

User Content

Your Content

You retain ownership of flashcard decks and other content you create ("User Content"). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content as part of the Service.

Content Guidelines

You agree not to post content that:

Infringes on intellectual property rights
Contains illegal, harmful, or offensive material
Includes malware or malicious code
Violates the privacy of others
Is spam or commercial advertising (unless authorized)
Is inappropriate for an educational platform used by minors

Public Content

Content you mark as "public" may be viewed and used by other users for educational purposes. You are responsible for ensuring you have the right to share any content you make public.

Acceptable Use

You agree not to:

Use the Service for any illegal purpose
Attempt to gain unauthorized access to any part of the Service
Interfere with or disrupt the Service
Scrape, crawl, or use automated means to access the Service without permission
Impersonate others or misrepresent your affiliation
Use the Service to harass, abuse, or harm others
Attempt to contact minors inappropriately through the Service

Intellectual Property

Our Content

The Service, including its design, features, and pre-made educational content, is owned by StudyDek and protected by copyright, trademark, and other laws. You may not copy, modify, or distribute our content without permission.

Pre-Made Decks

Educational flashcard decks provided by StudyDek are for personal, non-commercial use. You may study with them but may not redistribute them outside the Service.

Third-Party Services

The Service may contain links to or integrations with third-party services (e.g., Google for authentication). Your use of third-party services is subject to their respective terms and privacy policies.

Advertising

Current Status: StudyDek does not currently display advertisements.

Practice Section: The Practice section (studydek.com/practice) is designed for children and will not display personalized advertisements. Any future advertising in this section will comply with COPPA requirements.

Future Advertising: If we introduce advertising to other sections of the Service, we will update these Terms and our Privacy Policy accordingly.

Disclaimers

Educational Content

The educational content on StudyDek is provided for informational and learning purposes only. We make reasonable efforts to ensure accuracy but do not guarantee the correctness, completeness, or usefulness of any content. Always verify important information with authoritative sources, particularly for academic or professional purposes.

"As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

No Guarantee of Availability

We do not guarantee that the Service will be available at all times or that it will be error-free. We may modify, suspend, or discontinue any part of the Service at any time.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STUDYDEK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your use or inability to use the Service
Any unauthorized access to or use of our servers
Any interruption or cessation of the Service
Any bugs, viruses, or other harmful code transmitted through the Service
Any content obtained from the Service
Any errors or omissions in educational content

Indemnification

You agree to indemnify and hold harmless StudyDek and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

Changes to Terms

We may modify these Terms at any time. We will notify users of material changes by posting a notice on the Service or updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you should stop using the Service.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.

Dispute Resolution

Informal Resolution

Before initiating any formal dispute resolution, you agree to first contact us at support@studydek.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days.

Arbitration

If informal resolution is unsuccessful, any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in California.

Exceptions

Either party may seek injunctive relief in court for intellectual property violations. Small claims court actions are also permitted.

Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

Note: The arbitration clause and class action waiver may not be enforceable in all jurisdictions or may not apply to certain types of claims.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and StudyDek regarding the Service and supersede any prior agreements.
